At the bottom of this page is a NEW letter released explaining Sheriff Jim Winder's position. He agrees with most of the letter. Partly he is not part of the Utah Sheriff Association. His letter worth the read.

The Utah Sheriffs’ Association has written a strongly worded letter to President Obama on the issue of gun control.
Even though the president’s executive orders and suggested legislation don’t mention confiscating firearms, the sheriffs seem to anticipate such a move.
Part of the letter reads, “No federal official will be permitted to descend upon our constituents and take from them what the Bill of Rights—in particular Amendment II—has given them.”
The Sheriffs in 28 of 29 Utah counties have signed the letter, with Jim Winder of Salt Lake County being the only Sheriff not to join in; he is not a member of the Utah Sheriffs’ Association.

Dear President Obama:
We, the elected sheriffs of Utah, like so many of our fellow Americans, are literally heartbroken for the loved ones of the murdered victims in Connecticut. As Utahans, we are not strangers to this kind of carnage—one of the latest being the 2007 Trolley Square murders wherein nine innocents were gunned down—five losing their lives.
We also recognize the scores of other recent domestic massacres, which have decimated countless honorable lives. As Americans, we value the sanctity of life. Furthermore, similar to our inspired Founders, we acknowledge our subservience to a higher power.
With the number of mass shootings America has endured, it is easy to demonize firearms; it is also foolish and prejudiced. Firearms are nothing more than instruments, valuable and potentially dangerous, but instruments nonetheless. Malevolent souls, like the criminals who commit mass murders, will always exploit valuable instruments in the pursuit of evil. As professional peace officers, if we understand nothing else, we understand this: lawful violence must sometimes be employed to deter and stop criminal violence. Consequently, the citizenry must continue its ability to keep and bear arms, including arms that adequately protect them from all types of illegality.
As your administration and Congress continue to grapple with the complex issue of firearm regulations, we pray that the Almighty will guide the People’s Representatives collectively. For that reason, it is imperative this discussion be had in Congress, not silenced unilaterally by executive orders. As you deliberate, please remember the Founders of this great nation created the Constitution, and its accompanying Bill of Rights, in an effort to protect citizens from all forms of tyrannical subjugation.
We respect the Office of the President of the United States of America. But, make no mistake, as the duly-elected sheriffs of our respective counties, we will enforce the rights guaranteed to our citizens by the Constitution. No federal official will be permitted to descend upon our constituents and take from them what the Bill of Rights—in particular Amendment II—has given them. We, like you, swore a solemn oath to protect and defend the Constitution of the United States, and we are prepared to trade our lives for the preservation of its traditional interpretation.

Sheriff Winder Statement Regarding Utah Sheriff's Association Letter To President Obama
Recently the Utah Sheriff’s Association prepared a preemptive message to
President Obama stating their position on the current debate and
presidential proposals concerning gun laws in the United States. The
Salt Lake County Sheriff’s Office is not currently a member of the Utah
Sheriff’s Association and therefore, was not a signatory of the letter.
This has raised a lot of questions from the citizens of Salt Lake County
as to why Sheriff Winder did not sign the letter and asking what his
position is in regards to the issue.
This is a statement of the
Sheriff's Office and the Unified Police Departments (UPD) position on
this very complex and important issue.
While not a member of the Utah Sheriff's Association, Sheriff
Winder supports the majority of the intent of the letter.
However, after
a review of the proposals suggested by the Obama Administration, we
agree with the association president that currently there is nothing
proposed that we object to and we can find no reason to believe that
there would ever be a situation where federal officers would be
permitted to descend upon our constituents and take from them their
rights. We are confident in the process that Congress and the courts
will continue to protect our rights as established.
Sheriff Winder and the members of the Sheriff's Office and UPD
fully support, obey and defend the constitution of the United States and
the constitution of the State of Utah.
We are a country of laws and
order, guided by long established government processes that are meant to
ensure and protect our freedoms, including the right to bear arms. We
have taken an oath to obey those laws and will do so. The
constitutionality of all laws is determined by independent evaluation
and scrutiny by the judicial branch of government. Once that has been
done and a law has been determined to be constitutional, every law
enforcement officer has the duty to enforce it. The determination of
whether or not a law is constitutional is not left up to any one person
or group or collective group. If it were we would cease being a nation
of freedoms.
Sheriff James M. Winder, the Salt Lake County Sheriff's Office and
Unified Police Department fully supports the Second Amendment as
established by the Constitution as well as every other Amendment
provided by it and will defend those rights of the citizens of Salt Lake
County.

A letter that was sent to President Barack Obama last week by the Utah Sheriff's Association concerning his executive orders and suggestions to congress on how to act on the issue of gun violence had the signatures of most of the county sheriffs in the state.
However, at least one of those signatures was electronic and not necessarily reflective of the views of the person it belongs to, Carbon County Sheriff James Cordova.
"I did not formally sign that letter," said the Sheriff on the phone in a short conversation with the Sun Advocate on Tuesday afternoon. "I would not take that heavy of a stand."
The letter that was released to the press on Monday by Summit County Sheriff Dave Edmunds, president of the group, stated that the association's members would not allow federal officials to come in and take away citizens' guns.
"We acknowledge that that hasn't happened yet," Sheriff Edmunds told KUTV News. "But (concerning) all that we're hearing from the Obama administration and their surrogates, we believe that they are trying to make a grab at guns."
The letter stated a number of things including the empathy the association has for Sandy Hook, Conn. residents (shooting at the elementary school there last month) and how Utah was not immune to that kind of thing (Trolley Square shootings that took nine lives). But it also stated that the Utah Sheriff's Association feels that the way the President is going about controlling the mayhem is wrong.

Cordova said the letter came to him through email, but he did not get to look at it before it was sent out, and did not inform them to go ahead and use his signature.
"It is my job to uphold the law and defend the Constitution," he said. "They used electronic signatures after the fact."
Probably the passage in the letter that has garnered the most attention is the one where the association tells the President that they will not allow the confiscation of firearms.

The correspondence had gone viral as of Tuesday afternoon and its contents were being reported on blogs, electronic bulletin boards and in newspapers around the country. Statewide media had reported that Salt Lake County Sheriff Jim Winder did not sign the letter, but then he is not a member of the association. He pulled his department out of it last year.
As of Tuesday the upstate media had not reported that other sheriffs many have been in the same boat as Cordova. It is unknown how many of them actually saw the letter before it was sent.
